This Agreement includes a disclaimer of liability in Section 7. Please review that section (and all other terms) carefully.

This CLIENT AGREEMENT (this “Agreement”) is a legal agreement between RetraceHealth, Inc. (“RetraceHealth,” “us,” or “we”) and you individually (in each case “you” or “your”).

By accessing or using the Services, you agree to bound by this Agreement as posted and accessible through on or website at the time of your access or use and to use the Services in accordance with the terms and conditions of this Agreement, our Privacy Policy at retracehealth.com and any additional terms and conditions that are referenced herein or that otherwise may apply to specific features of the Services, or to products or services that we make available to you through the Services (all of which are deemed part of this Agreement). If you do not agree to the terms and conditions of use for the Services as set forth in this Agreement, you may not use the Services.

If you wish to participate as a client of RetraceHealth, you must click on the “I accept the terms and conditions of this Agreement” button. By clicking the “I accept the terms and conditions of this Agreement” button you acknowledge: (a) that you have read and understood this Agreement; and (b) that this Agreement has the same force and effect as an agreement signed with original signatures. If you do not click on the “I accept the terms and conditions of this Agreement” button you will not be entitled to participate as a client of RetraceHealth.

This Client Agreement was last revised in December 2016. We reserve the right to change the terms contained herein, in our sole discretion, at any time. BY CONTINUING TO USE THIS SITE AFTER SUCH CHANGES ARE POSTED, YOU AGREE TO BE BOUND BY THE MOST RECENT VERSION OF THIS CLIENT AGREEMENT. You are expected to check this page each time you access this Site so you are aware of any changes, as they are binding on you. This applies whether we give you notice of the changes or not.

You warrant that you have full authority to accept and perform this Agreement.

1. Fees

You may use funds from a health savings account or credit card to pay for medical services administered by RetraceHealth and provided by Yellow Coriander, P.S.C. clinicians.

2. Scope of Services

RetraceHealth clients receive primary care services provided by advance practice nurses and registered nurses, medical assistants, and phlebotomists only who are employed by Yellow Coriander, P.S.C.; it does not cover physician services. Yellow Coriander, P.S.C. clinicians treat certain acute conditions, chronic conditions, and provide a limited scope of preventive services. Such services include, but are not limited to skin conditions, eye conditions, ear/nose/throat/mouth conditions, gastrointestinal conditions, respiratory issues, genitourinary issues, musculoskeletal conditions, neurologic conditions, common illnesses, minor injuries, women’s health issues, certain medication refills, preventative screening or counseling, physical exams, and treatment of common chronic conditions.

If a Yellow Coriander, P.S.C. clinician affiliated with RetraceHealth is unable to treat a condition, or feels that you need additional care, you may be referred to a clinic or another health care provider, not affiliated with RetraceHealth or Yellow Coriander, P.S.C for which you will be responsible for all incurred expenses. The nurse practitioners will have the sole right to determine whether a service is within their ability and scope of practice. RetraceHealth does not cover specialist care or the care of any other health care providers.

RetraceHealth does not cover the following types of conditions and Yellow Coriander, P.S.C. clinicians do not provide treatment for the following types of conditions: severe injuries requiring replacement of bones, or skin, no casting; injuries involving sensitive areas, like eyes, face, or groin; puncture wounds or human bites; potentially compromised immune systems; diabetes with neuropathy, retinopathy, or nephropathy; COPD or severe asthma (defined as having been intubated or hospitalized in the last 5 years); congestive heart failure; or seizure disorders.

RetraceHealth does not cover the following types of services and Yellow Coriander, P.S.C. clinicians do not provide treatment for the following types of services: acupuncture, infertility, sexual dysfunction, weight loss treatment, chiropractic care, cosmetic surgery, dental care, drug and alcohol treatment, emergency services, hearing care, home healthcare, hospice care, hospital care, massage therapy, prostate exams for men, prenatal/perinatal care, maternity/labor and delivery, naturopathy, female pelvic exams (pap, STD, pelvic pain), psychiatric care, rehabilitation, sterilization, vision care, colonoscopy, CT Scans, PET Scans, endoscopy, mammograms, MRI, and outpatient surgery.

3. Uncovered Services

RetraceHealth memberships do not cover the cost of vaccines, durable medical equipment, or specialty labs. Payments may be made by cash, check, or credit card. RetraceHealth will notify you regarding the uncovered amount prior to administering any uncovered service.

4. Availability of Clinicians

All appointments with Yellow Coriander, P.S.C. clinicians will be conducted via phone, email, video, or in your home. Information about scheduling and available appointment times is available at RetraceHealth.

5. Cancellation Policy

You may cancel your appointment with RetraceHealth a minimum of 24 hours in advance, otherwise your visit fees may not be refunded.

6. Prescription Policies

Prescriptions issued by Yellow Coriander, P.S.C. clinicians are limited to common prescription medications, like antihistamines and antibiotics, and maintenance medications, such as those used to treat high cholesterol, diabetes, and hypertension. In certain cases, nurse practitioners may prescribe lifestyle medications or diet pills. Prescriptions are issued only at the discretion of the nurse practitioner, and are never guaranteed.

Yellow Coriander, P.S.C. clinicians do not prescribe any medications on the Drug Enforcement Administration list of controlled substances to new patients, which includes narcotics and amphetamines such as oxycodone or Adderall. In addition, Yellow Coriander, P.S.C. clinicians will not manage chronic pain medication, defined as more than two weeks in duration.

All prescription refills should originate from the RetraceHealth client and should be done within five days of running out of your prescription medication. Refills can be done by either scheduling a video visit with any Yellow Coriander, P.S.C. clinician or by contacting your pharmacy for a refill request that they will fax to your nurse practitioner.

It is important that you have all of your medication bottles on hand at each one of your medical visits, including any herbal supplements and vitamins you are taking. This is important to make sure you are taking the correct medications at the correct doses and that the medications and supplements are also safe to take together.

The majority of our prescription refills will be sent electronically to the pharmacy of your choice. Prescriptions for certain controlled substances, please see the controlled substance policy, will have to be hand written and therefore either mailed to the address you have on file with RetraceHealth or can be brought to you during a home visit.

RetraceHealth clients who are taking maintenance prescription medications for chronic medical conditions do require regular virtual visits and may require a home visit by either the nurse practitioner or a medical assistant based on the nurse practitioner’s discretion. If you request a refill through your pharmacy but you are overdue for a medical visit or blood work, (if necessary for monitoring the safety and effectiveness of the medication), it is at the nurse practitioner’s medical judgment to either withhold or refill your medication until the proper monitoring has been completed.

7. Limitation on Liability

RETRACEHEALTH’S AGGREGATE LIABILITY SHALL, IN ALL CASES, BE LIMITED TO THE AMOUNT PAID BY YOU TO BE A PARTICIPATING CLIENT OF RETRACEHEALTH. RetraceHealth does not practice medicine or any other profession, and is not to be held liable for any malpractice claims based upon healthcare services administered RetraceHealth and provided by Yellow Coriander, P.S.C. clinicians.

8. Waiver Permitting Video and In-Home Visits

Video and in-home visits are a critical aspect of RetraceHealth’s ability to administer competent health care services provided by Yellow Coriander, P.S.C clinicians. Video conferencing, texting, and e-mail are not always secure mediums and there can be no guarantee that others will not access health information you share as a RetraceHealth client. RetraceHealth does not guarantee the security of any technological mediums used to provide patient care.

You acknowledge and agree that your expectation of privacy is limited by the nature of being a RetraceHealth client, and despite this limited expectation of privacy, you agree to participate as a client of RetraceHealth. In addition, you are permitting Yellow Coriander, P.S.C. nurse practitioners and registered nurses to interact with you via video-conferencing, text, e-mail, and to enter your home to conduct in-home visits.
